Muhammad narrated in Shuf’at Al-Asl from the Prophet (ﷺ) that he said: "Whoever buys land containing palm trees, the fruits belong to the seller unless the buyer stipulates otherwise."
Commentary and footnotes (2)

Note 1

The fruits belong to the seller unless the buyer stipulates otherwise

(1) "The fruits belong to the seller unless the buyer stipulates otherwise"—This applies regardless of whether the trees have been pollinated or not. Al-Shafi’i held that before pollination, the fruits belong to the buyer, and after pollination, to the seller. Abu Hanifah, however, maintained that the fruits always belong to the seller unless the buyer explicitly claims them, based on this hadith. The hadith in the Six Books stating, "Whoever sells a pollinated palm tree, its fruits belong to the seller unless the buyer stipulates otherwise," does not contradict this, as the implied condition is not binding in our school. Some argued that Muhammad’s narration is gharib (rare), but a jurist’s reliance on a hadith validates it. The Hanafi position is supported by analogy (qiyas) with crops, as mentioned in Al-Hidayah: "The fruit is attached for harvesting, not for retention." Al-‘Ayni attempted to reconcile the two hadiths by interpreting "pollination" as a metaphor for the fruit’s visibility, meaning the buyer owns the fruit before it becomes apparent (i.e., in the year of sale) and the seller afterward. Thus, the hadith aligns with Abu Hanifah’s view.
