Abdullah ibn Umar (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "Whoever sells a pollinated palm tree, its fruits belong to the seller unless the buyer stipulates otherwise." [Agreed upon]
In Bukhari’s narration from Zayd ibn Thabit (may Allah be pleased with him): "During the Prophet’s time, people traded fruits. When harvest time came and payment was due, the buyer would complain: 'The fruits were damaged by pests or disease,' using these as excuses. When disputes increased, the Prophet (ﷺ) said: 'Do not sell fruits until they are clearly ripe,' advising them due to frequent disputes."

Note 1
(1) The statement: "Its fruits belong to the seller unless the buyer stipulates otherwise" – There is no disagreement on the prohibition of selling fruits before they appear or after appearance but before ripening if left on the tree. Selling before ripening with the condition of picking (for immediate use) is permitted, as is selling after ripening. For us, ripening means safety from damage, while for Al-Shafi’i, it is when sweetness appears. The disagreement concerns selling before ripening without picking conditions. Al-Shafi’i, Malik, and Ahmad prohibited it, while we permit it if the fruit is unusable (inedible or unfit for animal feed)—though scholars differ. The correct view is permissibility because it will eventually be useful. If usable (even as animal feed), the sale is valid by consensus if picking is stipulated or left open. Our evidence is this hadith, where the Prophet (ﷺ) assigned the fruits to the seller unless the buyer claimed them, implying permissibility of selling unripe fruits if claimed separately. Opponents cannot argue with prohibition hadiths, as they themselves permit selling before ripening with picking conditions, contradicting those hadiths. Our scholars interpret prohibition hadiths as discouragement or referring to sales where fruits are left to ripen (invalid by consensus) or sales conditioned on leaving fruits unharvested. Alternatively, the Prophet’s prohibition was advice due to frequent disputes, as in Bukhari’s narration where he said: "Do not sell until fruits ripen," as counsel.
