Note 1
(1) His statement: “He is liable”: Meaning, for blood money, and retribution is waived due to the patient’s permission. The physician’s offense is upon the clan per most jurists. (Al-Luma’at and Al-Mirqat, excerpted from them). It is said in (Badhl al-Majhud): "In summary, if the physician performs a treatment with his hand, like cutting a vein, incising the skin, cauterizing, or administering medicine with his hand, and it leads to death, it is an offense requiring blood money. If he prescribes medicine and explains it to the patient, and the patient takes it with his own hand, there is no liability."
