(1) The statement: A believer does not assassinate: Meaning one with complete faith, as the Companions, when passing a heedless disbeliever, would alert them, and if they refused Islam after invitation, they would kill them. Thus, it is stated in Al-Hidaya: When Muslims enter enemy territory and besiege a city or fortress, they invite them to Islam. It is stated in Al-Mirqat: If asked: The Messenger of Allah (ﷺ) sent Muhammad ibn Salama al-Khazraji with a group to kill Ka‘b ibn al-Ashraf, Abdullah ibn Atik al-Awsi with a group to kill Rafi‘, and Abdullah ibn Anis al-Juhani to kill Sufyan ibn Khalid, so how to reconcile this hadith with those incidents he ordered? We say: The prohibition on assassination may have come after, which is more likely, as the first was in the third year, the second in the fourth, the third after the Trench in the fifth, and Abu Hurayra’s Islam was in the seventh year at Khaybar. It is possible this was specific to the Prophet (ﷺ) due to his divine protection. It is also possible those incidents were by divine command, as the killed showed treachery against the Prophet (ﷺ), insulted him impermissibly, slandered excessively, and incited against him. Al-Tayyibi said: The judge favored this view and summarized it, saying: Faith prohibits and forbids this, so a believer should not do it. If the target is Muslim, it is clear; if a disbeliever, a warning and call to repentance must precede, as the goal is not killing but perfection and invitation to Islam as possible. This is unless a religious necessity arises, like knowing they persist in disbelief, are eager to kill Muslims, and seize opportunities, where repelling them is only possible this way, and there is no harm in it.
