٤١١٥ - وَعَنْ سَلْمَانَ قَالَ: سُئِلَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم عَنْ السَّمْنِ وَالْجُبْنِ وَالْفِرَاءِفَقَالَ: (الْحَلَالُ مَا أَحَلَّ اللَّهُ فِي كِتَابِهِ، وَالْحَرَامُ مَا حَرَّمَ اللَهُ فِي كِتَابِهِ، وَمَا سَكَتَ 4 عَنْهُفَهُوَ مِمَّا عَفَا عَنْهُ). رَوَاهُ ابْنُ مَاجَه وَالتَّرْمِذِيُّ.

(4) The statement: “What He was silent about is among what He has pardoned”: This indicates that the default ruling for things is permissibility according to most Hanafi and Shafi’i scholars, supported by Allah’s saying: “He has created for you all that is on earth” (Qur’an 2:29). It is said: Everything was created for His servants, and they were created for His worship, per “And I did not create the jinn and mankind except to worship Me” (Qur’an 51:56), per “Al-Mirqat” and “Radd al-Muhtar.”

(٤) قوله: وما سكت عنه فهو مما عفي عنه: وفيه أن الأصل في الأشياء الإباحة عند الجمهور من الحنفية والشافعية،ويؤيده قوله تعالى: (هُوَ ٱلَّذِي خَلَقَ لَكُم مَا فِي الْأَرْضِ جَمِيعًا) (البقرة: ٢٩). وقد قيل: كل شيء خلق لعبادهوخلقوا لعبادته. قال تعالى: (وَمَا خَلَقْتُ الْجِنَّ وَالْإِنْسَ إِلَّا لِيَعْبُدُونِ (٤) (الذاريات: ٥٦). التقطته من (المرقاة)و(ردالمحتار).
