Chapter on Musaqah and Muzara‘ah

Zujajat al-Masabih 3095aVolume 2

English

Hanzalah ibn Qays narrated from Rafi‘ ibn Khadij that his uncles said they leased land in the Prophet’s (ﷺ) time for what grows on the channels or what the owner stipulates. The Prophet (ﷺ) forbade this. I asked Rafi‘, “What about dirhams and dinars?” He said, “No harm in that.” The prohibition was for what the knowledgeable in halal and haram would not permit due to risk. .

Note 1

What grows on the channels…

(1) “What grows on the channels…”: They leased land for the worker to sow, with channel crops as rent, or a specific plot’s yield for the lessor, the rest for the lessee. This was forbidden due to risk, the basis for prohibition by those allowing muzara‘ah. [From Al-Luma‘at].
