Note 3

(3) Regarding the saying: No hijra after the conquest, etc.: Al-Urf al-Shadhi states: Hijra from the abode of war to the abode of Islam is disputed among later scholars and not addressed in Hanafi books, though the Shafi‘is discuss it here. Shah Abdul Aziz, in some treatises, favored the desirability of hijra, which is the preferred view. Some scholars held its obligation, and hadiths and verses suggest desirability, including Tirmidhi’s narration (p. 195) from Burayda, indicating they are like Muslim Bedouins, subject to the same rulings. It was obligatory for Makkah’s people and may be obligatory in certain cases. (1) Regarding the saying: When you are called to arms, go forth: Al-Nawawi said: This proves jihad is not an individual obligation but a collective one. If enough undertake it, the burden is lifted from the rest; if all abandon it, all sin.
