Chapter: Reviving Dead Land and Water Rights

Zujajat al-Masabih 3122aVolume 2

English

Amr ibn Shu’aib narrated from his father, from his grandfather, that the Messenger of Allah (ﷺ) judged regarding a channeled stream that it be held until it reaches the ankles, then the upper land sends it to the lower. [Narrated by Abu Dawud and Ibn Majah] Muhammad said: We adopt this, as it was the agreement among them. Each people have what they agreed and submitted to regarding their springs, streams, rivers, and water shares.

Held until it reaches the ankles, etc.—Shafi’i stated in Al-Minhaj

(1) The statement: Held until it reaches the ankles, etc.—Shafi’i stated in Al-Minhaj: Permissible waters from valleys, springs, streams, and rains are equal for people. If people want to irrigate their land from it and it is insufficient, the upper land irrigates first, and each holds the water until it reaches the ankles. As stated in Al-Musawwa. In At-Ta’liq Al-Mumajjad: According to the Hanafis, there is no specific limit set by Sharia, but the matter is left to the partners’ opinions. This is the summary of what Muhammad (may Allah be pleased with him) said.
