Amr ibn Shu‘aib, from his father, from his grandfather (may Allah be pleased with him) narrated from the Prophet (ﷺ): If one of you marries his slave to his female slave, he should not look at her private parts [Narrated by Abu Dawud]. In a narration by Ad-Daraqutni from him, the Prophet (ﷺ) said: If one of you marries his female slave to his slave or his hired man, he should not look at what is below the navel and above the knee, for what is below the navel to the knee is the private part. In another narration by him from Ali, the Prophet (ﷺ) said: The knee is part of the private part. Abdul-Razzaq narrated from Anas that Umar struck a female slave of Anas’s family when he saw her veiled, saying: Uncover your head; do not resemble free women.

٣٢١٩ - وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ(رضي الله عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «إِذَا زَوَّجَ أَحَدُكُمْ عَبْدَهُ أَمَتَهُ فَلَا يَنْظُرُ إِلَى عَوْرَتِهَا. رَوَاهُ أَبُو دَاوُدَ.
وَفِي رِوَايَةٍ لِلدَّارَ قُطْنِي عَنْهُ أَنَّ النَّبِيَّ ﷺ قَالَ: «وَإِذَا زَوَّجَ أَحَدُكُمْ أَمَتَهُ عَبْدَهُ أَوْ أَجِيْرَهُ فَلَا يَنْظُرُ إِلَى مَا دُوْنَ السُّرَّةِ وَفَوْقَ الرُّكْبَةِ؛ فَإِنَّ مَا تَحْتَ السُّرَّةِ إِلَى الرُّكْبَةِ مِنَ الْعَوْرَةِ». وَفِي رِوَايَةٍ لَهُ عَنْ عَلَى أَنَّ النَّبِيَّ ﷺ قَالَ: «الرُّكْبَةُ مِنَ الْعَوْرَةِ»، وَرَوَى عَبْدُ الرَّزَّاقِ عَنْ أَنَسٍ ، أَنَّ عُمَرَ ضَرَبَ أَمَةً لِآلِ أَنَسٍ رَآهَا مُتَقَنِّعَةً، فَقَالَ: اكْشِفِي1 رَأْسَكِ، لَا تَتَشَبَّهِيْ بِالْحَرَائِرِ.

عمرو بن شعیب رضی اللہ عنہ اپنے والد کے واسطے سے اپنے دادا سے روایت
کرتے ہیں ان کے دادا (حضرت عمرو بن عاص رضی اللہ عنہ) حضور نبی کریم صلی اللہ علیہ وآلہ وسلم
سے روایت کرتے ہیں کہ آپ نے ارشاد فرمایا کہ جب تم میں سے کوئی اپنے غلام کا نکاح اپنی
باندی سے کر دے تو اپنی باندی کے ستر کو نہ دیکھے۔ اس کی روایت ابوداؤد نے کی ہے۔
اور دارقطنی کی ایک روایت میں حضرت عمرو بن العاص رضی اللہ عنہ سے
مروی ہے کہ نبی کریم صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا کہ جب تم میں سے کوئی اپنی باندی کا
نکاح اپنے غلام یا اپنے خادم سے کر دے تو اس باندی کی ناف سے لے کر گھٹنے تک کے اعضاء کو نہ
دیکھے اس لئے کہ ناف سے لے کر گھٹنے تک ستر (میں داخل) ہے۔
اور دارقطنی کی ایک اور روایت حضرت علی رضی اللہ عنہ سے مروی ہے کہ نبی
کریم صلی اللہ علیہ وآلہ وسلم نے فرمایا کہ گھٹنے تک بشمول پستان کے ستر (میں داخل) ہے۔
اور عبدالرزاق نے حضرت انس رضی اللہ عنہ سے روایت کی ہے کہ حضرت
عمر رضی اللہ عنہ نے آل انس رضی اللہ عنہ کی ایک لونڈی کو گھونگھٹ ڈالے ہوئے دیکھا تو اس کو مارا
اور فرمایا اپنے سر کو کھول دے اور حرہ عورتوں سے اپنے کو مشابہ نہ کر۔

(1) The statement: Uncover your head, etc. For these hadiths, it is said in Al-Hidayah: According to us, the navel is not part of the private part, contrary to what Ash-Shafi‘i says. The knee is part of the private part, also contrary to him. It is mentioned in Kitab Ar-Rahmah fi Ikhtilaf Al-Ummah: They agreed that the navel of a man is not a private part. As for the knee, Malik, Ash-Shafi‘i, and Ahmad said it is not part of the private part, while Abu Hanifah and some of Ash-Shafi‘i’s companions said it is. As for the private part of a female slave, Malik and Ash-Shafi‘i said it is like that of a man, while Abu Hanifah added her belly and back. End of quote. For this narration.

(۱)قوله : اكشفي رأسك إلخ ولهذه الأحاديث قال في «الهداية»: أن السرة عندنا ليست من العورة، خلافا لما يقوله الشافعي : والركبة من العورة خلافًا له أيضًا، وذكر في كتاب الرحمة في اختلاف الأمة»: اتفقوا على أن السرة من الرجل ليست بعورة، وأما الركبة فقال مالك والشافعي وأحمد ليست من العورة، وقال أبو حنيفة من وبعض أصحاب الشافعي: إنها منها. وأما عورة الأمة فقال مالك والشافعي: هي كعورة الرجل، زاد أبو حنيفة بطنها و ظهرها، انتهى. لهذا الأثر.
