Note 1
(1) The statement: Take for him a cluster with a hundred twigs and strike him once: It is stated in Al-Durr al-Mukhtar and Radd al-Muhtar: A sick person who commits adultery is stoned and not flogged until he recovers, unless recovery is hopeless, then the punishment is applied by striking lightly as he can bear. In Al-Fath: If the illness is incurable, like tuberculosis, or he is physically weak, in our view and al-Shafi‘i’s, he is struck with a cluster of a hundred twigs at once. All must reach his body, so it is said they must be spread out. The cluster is a bunch of palm twigs.
