Note 1
(1) The statement: Zakat, prescribed punishments, war spoils, and Friday prayers are for the ruler: Meaning only the Imam implements them. A master cannot enforce a prescribed punishment on his slave without the Imam’s permission, as held by Abu Hanifa, supported by these narrations. Al-Shafi‘i said: A master may enforce the punishment on his slave, citing the Prophet’s (ﷺ) saying: If one of your slave women commits adultery and it is proven, let him enforce the prescribed punishment on her, until the mention of poetry. Our scholars, as in Ghayat al-Bayan and elsewhere, responded that this is understood as the master facilitating the punishment by referring it to the Imam, not directly enforcing it without permission. Al-Ayni said: It is understood as facilitating by referring to the Imam, as the apparent meaning is abandoned by consensus, since it implies obligation, but it is not obligatory for a master to enforce the punishment on his slave by consensus. This is clear in our school, and in al-Shafi‘i’s, as he allows but does not require it. Since the hadith’s apparent meaning is abandoned, we interpret it as stated. Al-Kaki said: The benefit of specifying slaves is to avoid burdening them, preventing masters from refraining from enforcing punishments.
