Ibn Abbas (may Allah be pleased with them) narrated that the Prophet (ﷺ) said: If a man says to another man, O Jew, strike him twenty times. If he says, O effeminate, strike him twenty times. Whoever has intercourse with a forbidden relative, kill him. [Narrated by al-Tirmidhi.] This is a deterrent and policy, and his ruling is the ruling of other adulterers.

٣٦٠٨- وَعَنِ ابْنِ عَبَّاسِ رضي الله عُنهَماعَنِالنَّبِيِّ ﷺ قَالَ:(اِذَاقَالَ1 الرَجُلُ للرَجُلِ يا يَهُودِيُّ، فَاضْرِبُوهُ عِشْرِينَ، وَإِذَا قَالَ: يَا مُخَنَّثُ، فَاضْرِبُوهُ عِشْرِينَ، وَمَنْ وَقَعَ عَلَى2ذات محْرَمٍ فَاقْتُلُوه). رَوَاهُ التِّرْمِذِيُّ. وَهَذَا زَجْرُ وَسِيَاسَةُ، وَحُكْمُهُ حُكْمُ سَائِرِ الزُّنَاةِ.

فرمایا جب کوئی شخص کسی شخص کو ”اے یہودی“ کہے 3 تو تم اس کو بیس (20) ضرب لگاؤ اور اگر ”اے
مخنث“ کہے تو تم اس کو بیس (20) ضرب لگاؤ اور جو آدمی کسی محرم خاتون کے ساتھ (زنا کا) ارتکاب
کرے تو اس کو قتل کردو۔ 4 (ترمذی)

(1) The statement: If a man says to another man, O Jew, etc.: Abu Burda’s narration is abrogated by this narration, as it is established that the Prophet (ﷺ) exceeded ten lashes. [Taken from al-Luma’at.] In al-Durr al-Mukhtar: The one who insults with O effeminate or O Jew is disciplined. The criterion is that if he attributes to him a voluntary prohibited act that is considered a disgrace by custom, he is disciplined; otherwise, not. [Ibn Kamal.]

(2) The statement: Whoever has intercourse with a forbidden relative, kill him: It is said: This applies to one who permits it. Al-Muzhir said: Ahmad ruled by the apparent narration. Others said: This is a deterrent; otherwise, his ruling is that of other adulterers, stoned if chaste, lashed if not chaste. [As in al-Marqah.]

(١)قوله: اذا قال الرجل للرجل يايهودي الخ: حديث أبي بردة منسوخ بهذا الحديث؛ لأنه قد ثبت فيه ان النبي ﷺ کان یجاوز العشرۃ اخذته من (اللمعات) وقال في (الدرالمختار) عزرالشاتم ب(يامخنث يا يهودي) والضابط انه متي نسبه الي فعل اختياري محرم شرعا ويعد عارا عرفا يعزر والا لا.ابن كمال .

(٢)قوله: من وقع علي ذات محرم فاقتلوه: قيل: إنه محمول على المستحل لذلك. وقال المظهر: حكم أحمد بظاهر :الحديث. وقال غيره: هذا زجر وإلا حكمه حكم سائر الزُناة، يرجم إن كان محصنًا، ويجلد إن لم يكن محصنًاً. كذا في (المرقاة).
