Zujajat al-Masabih 3051aVolume 2

English

Sa‘id ibn Al-Atwal narrated: My brother died and left three hundred dinars and young children. I wanted to spend on them, but the Messenger of Allah (ﷺ) said to me: “Your brother is detained by his debt, so pay it on his behalf.” I went and paid it on his behalf, then came and said: “O Messenger of Allah, I have paid it on his behalf, and only a woman claiming two dinars remains, but she has no proof.” He said: “Give it to her, for she is truthful.”

Note 1

My brother died and left three hundred dinars and young children, and I wanted to spend on them, but the Messenger of Allah (ﷺ) said: Your brother is detained by his debt, so pay it on his behalf

(1) The statement: “My brother died and left three hundred dinars and young children, and I wanted to spend on them, but the Messenger of Allah (ﷺ) said: Your brother is detained by his debt, so pay it on his behalf”: For this reason, our Hanafi scholars said: Debt takes precedence over inheritance. This is stated in As-Siraji.
