٣٣٦٤ - وَعَنْ عَلِيَّ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ: عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ، وَعَنِ الصَّبِيِّ حَتَّى يَشِبَّ، وَعَنِ الْمَعْتُوهِ حَتَّى يَعْقِلَ. رَوَاهُ التَّرْمِذِيُّ وَأَبُو دَاوُدَ، وَرَوَاهُ الدَّرِمِيُّ عَنْ عَائِشَةَ فَا وَابْنُ مَاجَهِ عَنْهُمُا.

ف: اس حدیث شریف کی روشنی میں فتح القدیر میں لکھا ہے کہ بچہ کی دی ہوئی طلاق واقع نہیں ہوگی اگرچہ کہ وہ عقلمند ہو اور مجنون اور سونے والے کی طلاق بھی واقع نہ ہوگی۔12
