English

Usamah ibn Zayd (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) sent us to some people from Juhaynah. I came upon a man from them, and I went to stab him, but he said: There is no god but Allah. I stabbed him and killed him. I came to the Prophet (ﷺ) and informed him. He said: Did you kill him when he testified that there is no god but Allah? I said: O Messenger of Allah, he only did that to seek protection. He said: Why did you not split open his heart? [Agreed upon] And in a narration by Jundub ibn Abdullah al-Bajali, the Messenger of Allah (ﷺ) said: What will you do with “There is no god but Allah” when it comes on the Day of Resurrection? He said it repeatedly.

Why did you not split open his heart

(1) His statement: “Why did you not split open his heart”: This indicates the well-known rule in jurisprudence and legal theory that rulings are based on apparent matters. So it is in (Al-Mirqat).

Note 2

قوله

(٢) قوله: فهلا شققت عن قلبه: فيه دليل للقاعدة المعروفة في الفقه والأصول أن الأحكام يحكم فيها بالظواهر. كذافي (المرقاة).
