Hadith 3722

(2) Regarding the saying: Swear by Allah, the One besides Whom there is no god, etc.: This means the oath is by Allah, Exalted is He, and emphasized by mentioning His attributes, such as saying: By Allah, the One besides Whom there is no god, Knower of the unseen and the seen, the Most Merciful, the Most Compassionate, Who knows the secret as He knows the open, this person has no claim on you or took this claimed wealth, nor any part of it. This is because people’s conditions vary; some refrain from swearing when emphasized, and if not emphasized, they may scheme, so it is emphasized to deter them. (٢) قوله: أحلف بالله الذي لا إله إلا هو إلخ: أي واليمين بالله تعالى ويغلظ بذكر أو صافه تعالى، أي يؤكد اليمين بذكرأوصاف الله تعالى، وذلك مثل قوله: والله الذي لا إله إلا هو عالم الغيب والشهادة الرحمن الرحيم الذي يعلم منالسر ما يعلم من العلانية ما لفلان هذا عليك ولا قبلك هذا المال الذي ادَّعاه، ولا شيء منه؛ لأن أحوال الناس شتّى،فمنهم من يمتنع عن اليمين بالتغليظ، ويحتال عند عدمه فيغلظ عليه لعلّه يمتنع بذلك.
