Hadith 2413

Volume 1

English

Sa'd (may Allah be pleased with him) narrated: When the Messenger of Allah (ﷺ) took the pledge from the women, a noble woman stood up, as if she were from the women of Mudar, and said, "O Prophet of Allah, we rely on our fathers, sons, and husbands. What is permissible for us from their wealth?" He said, "The fresh food that you eat and give as a gift."

Umayr, the freed slave of Abu Al-Lahm (may Allah be pleased with him), reported: My master ordered me to prepare some dried meat. A poor man came to me, and I fed him some of it. When my master found out, he beat me. I went to the Messenger of Allah (ﷺ) and mentioned this to him. He called my master and said, "Why did you beat him?" He replied, "He gave away my food without my permission." The Prophet (ﷺ) said, "The reward is shared between you." In another narration, he said, "I was a slave, so I asked the Messenger of Allah (ﷺ), 'Can I give charity from my master's wealth?' He said, 'Yes, and the reward is shared between you.'"

Aisha (may Allah be pleased with her) narrated: A man said to the Prophet (ﷺ), "My mother passed away suddenly, and I think if she had spoken, she would have given charity. Will she have a reward if I give charity on her behalf?" He said, "Yes." [Agreed upon] In another narration by Al-Daraqutni, a man asked the Prophet (ﷺ), "I had parents whom I honored during their lifetime. How can I honor them after their death?" The Prophet (ﷺ) said, "Honoring them after death includes praying for them along with your prayers and fasting for them along with your fasts."

Note 1

Will she have a reward?

(1) The statement: "Will she have a reward?" Our scholars have clarified in the chapter of Hajj on behalf of others that a person can dedicate the reward of his deeds to someone else, whether it is prayer, fasting, charity, or other acts. This is mentioned in Al-Hidayah. What necessitates this is what Al-Daraqutni reported: A man asked the Prophet (ﷺ), "I had parents whom I honored during their lifetime. How can I honor them after their death?" He said, "Honoring them after death includes praying for them along with your prayers and fasting for them along with your fasts." This is the summary of what is in Rad Al-Muhtar and Fath Al-Qadir.

Note 1

Hadith 2417

Volume 1

English

Umar ibn Al-Khattab (may Allah be pleased with him) narrated: I donated a horse in the cause of Allah, but the person who had it neglected it. I wanted to buy it, thinking he would sell it cheaply. I asked the Prophet (ﷺ), and he said, "Do not buy it, and do not take back your charity, even if he gives it to you for a dirham. For the one who takes back his charity is like a dog that returns to its vomit." In another narration, "Do not take back your charity, for the one who takes back his charity is like the one who returns to his vomit."

Note 2

Do not buy it.

(2) The statement: "Do not buy it." In Umdat Al-Qari, it is said: "There is a dislike for a man to buy back his charity, and this is the opinion of Malik, the scholars of Kufa, and Al-Shafi'i, whether the charity was obligatory or voluntary. If someone buys back his charity, the sale is not invalidated, but it is better to avoid it." Ali Al-Qari said: "Some scholars held that it is forbidden for the giver to buy back his charity based on the apparent meaning of the hadith, but the majority view is that it is disliked as a precaution, because the ugliness lies in the fact that the recipient might give the giver a discount due to the prior act of charity, making it akin to taking back the charity in that amount."

Note 3

Do not take back your charity.

(3) The statement: "Do not take back your charity." What is understood from Al-Bukhari's approach is that he does not differentiate between a gift and charity, but this is not the case. A gift can be taken back, with some disagreement and details, unlike charity, which cannot be taken back under any circumstances. This is what Al-Allamah Al-Ayni said in Umdat Al-Qari in the chapter on gifts. The author of Al-Durr Al-Mukhtar said: "Charity is like a gift in that both are voluntary acts, and thus it is not valid unless it is received, nor can it be taken back."

Note 3

Hadith 2418

Volume 1

English

Buraidah (may Allah be pleased with him) narrated: I was sitting with the Prophet (ﷺ) when a woman came to him and said, "O Messenger of Allah, I gave my slave girl as charity, and she has died." He said, "Your reward is guaranteed, and her inheritance has returned to you." [Narrated by Muslim] In another narration by Ibn Majah, Ibn Umar (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said, "Whoever dies owing fasts, a needy person should be fed on his behalf for each day." In Al-Jawhar Al-Naqi, it is said: "This is a Sahih Hadith." In another narration by Al-Tahawi, Amrah bint Abdur-Rahman said: I asked Aisha, "My mother died owing fasts of Ramadan. Can I fast on her behalf?" She said, "No, but give charity on her behalf for each day to a needy person, which is better than your fasting." In Umdat Al-Qari, it is said: "This is a sahih chain." In a narration by Muslim, she said, "She never performed Hajj. Can I perform Hajj on her behalf?" He said, "Yes, perform Hajj on her behalf."

Note 1

Her inheritance has returned to you.

(1) The statement: "Her inheritance has returned to you." The scholars unanimously agreed that if someone gives charity and then inherits it, it is permissible for them. Ibn Al-Tin said: "A group of Zahiris held a strict view and disliked taking it back through inheritance, saying it must be given to a needy person because it becomes the right of Allah." This reasoning contradicts the text. Do you not see that the Messenger of Allah (ﷺ) allowed the giver to take back his charity when it returned to him through inheritance, while Umar ibn Al-Khattab (may Allah be pleased with him) was prevented from buying back his charity? These two hadiths establish the permissibility of charity returning to the giver by Allah's decree and the dislike of it returning by the giver's own action. This is the summary of what is in Umdat Al-Qari, Al-Mirqat, and Sharh Ma'ani Al-Athar.

Note 3

When Ramadan begins.

(1) The statement: "When Ramadan begins." Some said: "The correct view is what Muhammad reported from Mujahid, and no one disagreed with it, that it is disliked to say, 'Ramadan has come' or 'Ramadan has gone,' because it is one of the names of Allah. However, most scholars hold that it is not disliked, as it appears in authentic hadiths." This is mentioned in Rad Al-Muhtar.

In it is a night better than a thousand months. Allah has made fasting in it obligatory and standing in prayer at night voluntary. Whoever draws near to Allah with a good deed in it is like one who fulfills an obligation in other times, and whoever fulfills an obligation in it is like one who fulfills seventy obligations in other times. It is the month of patience, and the reward of patience is Paradise. It is the month of compassion, and the provision of the believer is increased in it. Whoever feeds a fasting person in it will have his sins forgiven, his neck freed from the Fire, and he will have a reward like that of the fasting person without diminishing his reward in the least." We said, "O Messenger of Allah, not all of us have the means to feed a fasting person." The Messenger of Allah (ﷺ) said, "Allah grants this reward to whoever feeds a fasting person with a sip of milk, a date, or a drink of water. And whoever satisfies a fasting person, Allah will give him a drink from my pool, and he will never thirst until he enters Paradise. It is a month whose beginning is mercy, whose middle is forgiveness, and whose end is freedom from the Fire. Whoever eases the burden of his slave in it, Allah will forgive him and free him from the Fire."

Abu Hurairah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said, "Every deed of the son of Adam is multiplied, a good deed receiving ten to seven hundred times its reward. Allah says, 'Except for fasting, for it is for Me, and I will reward it. He gives up his desires and food for My sake.' The fasting person has two joys: one when he breaks his fast, and one when he meets his Lord. The breath of the fasting person is more pleasant to Allah than the scent of musk. Fasting is a shield. If one of you is fasting, he should not engage in foul speech or raise his voice. If someone insults him or fights him, he should say, 'I am fasting.'"

Note 1

The breath of the fasting person.

(1) The statement: "The breath of the fasting person." In Al-Mirqat, it is said: "This does not necessarily mean that the fasting person should not remove the odor with a toothstick (miswak), as Al-Shafi'i used this hadith to argue that using a miswak after midday is disliked. This is similar to a mother saying about her child's urine, 'It is more pleasant to me than rosewater,' which does not mean she should not wash it. This issue will be discussed further in the chapter on the etiquette of fasting, Allah willing." Al-Qaduri from the Hanafis, Ibn Al-Arabi from the Malikis, Abu Uthman Al-Sabuni, Abu Bakr ibn Al-Sam'ani, and others from the Shafi'is all agreed that it refers to Allah's pleasure and acceptance. Al-Qadi said: "Allah may reward him in the Hereafter so that its fragrance becomes more pleasant than musk." There was a disagreement between Shaykh Taqiuddin Ibn Al-Salah and Shaykh Izzuddin Ibn Abd Al-Salam regarding whether the pleasantness of the fasting person's breath is in this world or the Hereafter. Ibn Abd Al-Salam held that it is in the Hereafter, like the blood of a martyr, and he cited as evidence what Muslim, Ahmad, and Nasa'i reported from Ata' from Abu Salih: "More pleasant to Allah on the Day of Resurrection." This is mentioned in Umdat Al-Qari. Shaykh Ibn Al-Humam said: "As for the meaning, it does not necessitate the dislike of using a miswak, because it is based on the assumption that the miswak removes the odor, which is not proven. It only removes the visible effect on the teeth, such as yellowing, because the cause is the emptiness of the stomach from food, and the miswak does not fill it with food to remove the cause." In Umdat Al-Qari, it is said: "The Prophet (ﷺ) praised the fasting person's breath to discourage people from avoiding speaking to fasting people due to the odor, not to discourage fasting people from using a miswak. Allah is above needing pleasant scents, so we know for certain that the prohibition was not about preserving the odor but about discouraging people from disliking it."

The Quran will say, 'I prevented him from sleep at night, so allow me to intercede for him.' They will be allowed to intercede."

(1) The statement: "Every prisoner." This refers to those who are imprisoned for a right owed to Allah or to a person, and their release is a way of emulating Allah's attributes.

Note 1
